Investigating travel crimes and their punishments in the Afghan Penal Code

Abstract

The special geographical position of Afghanistan in the Asian continent, such as being surrounded by land and having long borders with uncontrollable areas, is always a big problem in controlling the passage of foreign nationals into the country;
The approval of the Law on Travel and Residence of Foreign Nationals in Afghanistan and the Passport Law are among the first and most important steps taken by legislators in the field of controlling travel and residence and maintaining social order. Foreign nationals are obliged to obtain permission to enter and obtain legal status from the host country, to respect all the regulations of that country and not to commit any illegal activity.Therefore, in order to control the general order and control of crossing the borders, the Afghan legislature has enacted a series of rules in the Travel and Residence Law, the Passport Law and finally in the Penal Code. Allowed with reactions, such as banning entry, expulsion, and sometimes they are punished according to the penal code.
