Abstract
An estate is the property left by a deceased person, which belongs to his heirs at the time of his death, but before the deceased owns his share of the inheritance according to the classes of inheritance and can take possession of the property left by the deceased, he must undergo a liquidation process. To do the inheritance in the order that is explained and described in jurisprudence and legal books. Settlement of the estate means that the debts and rights of the deceased are determined and paid, and the testator is expelled from the estate of the deceased. In this way, it is first necessary to remove the obligations of the deceased from the estate (the obligations of the deceased are the expenses related to the burial and other Shariah obligations related to the deceased.) After determining and paying the obligations and debts of the deceased, if the deceased has a will, He is removed from the estate and what remains of the estate belongs to his heirs under the title of inheritance, who can leave it jointly or the heirs can divide and determine their share by agreement and in case of disagreement by the court.
